Hearing the petition of Khadoor Sahib MP Amritpal and his associates challenging the imposition of National Security Act (NSA) and its extension, the Punjab-Haryana High Court has ordered the Punjab government to hand over the details of all the FIRs registered against them.
Amritpal’s associates Sarabjit Singh Kalsi, Gurmeet Gill, Pappalpreet Singh and others have said in their petition that the action of imposing NSA against them is unconstitutional, against the law and has been done in a malicious manner due to political disagreement. There is no such case against them on the basis of which they should be kept in preventive custody. They were not only kept in preventive custody for more than a year, but their freedom was taken away in an unusual and cruel manner by keeping them in custody away from Punjab.
The Punjab government said that the custody of Amritpal’s associates is very important for the security of the state. The government claims that Amritpal’s associates were in contact with the separatists even while in jail, so it is necessary to extend their custody. During the hearing, it came to light that it is not clear whether the petitioners are accused in the FIRs mentioned in the grounds of detention.
The High Court bench of Chief Justice Sheel Nagu and Justice Sumit Goyat has directed the District Magistrates of Amritsar and Moga to submit the complete details of all the FIRs registered against the petitioners within a week. It should be made clear whether the petitioners are accused in the cases which have been made the basis for detention or not.
